Methuen Man Dies in Snowmobile Accident

Mark Torres, 44, of Methuen died in a snowmobile crash off of Lowell Street  in Methuen Friday evening.  According to officials, Torres was trying to maneuver his snowmobile over a steep embankment alongside the Merrimack River around 8:00pm when the snowmobile landed on top of him, resulting in fatal injuries.

Torres had left his home at about 5:00 that night to go for a ride and when he didn’t come back home when expected, his wife rounded up friends and neighbors to search for him.  One of the friends found Torres shortly after searching for him and called 911.  He was rushed to an area hospital but was pronounced dead about an hour after being found.  Authorities are continuing to investigate the deadly crash.

Snowmobiles are owned and enjoyed by nearly 3 million people  across the country, with millions of other snowmobile enthusiasts around the world.  Each year, it’s estimated that about 200 people die in fatal snowmobiling crashes.  Snowmobilers in the U.S. also experience about 14,000 injuries in a given riding season.  The most commonly cited reasons why these tragedies occur involve speed, alcohol, and inexperience among riders.

Don’t Forget This Part of Your Game Plan on Super Bowl Sunday

Super Bowl Sunday is coming up fast and you most likely already have plans set up for where you’re going to see the February 6 game.  In preparation for the big game, don’t forget one of the most important plays of your day: getting home safely after the televised celebration wraps up.

In Massachusetts in 2009, 26% of drivers who were in the 333 deadly accidents that year registered a blood alcohol concentration (BAC) of .08 or higher.  Of those accidents, 30% of drivers involved in fatal crashes registered a BAC of .01 or higher.  If you’re going to be drinking on Super Bowl Sunday, please start your planning now to use public transportation, if possible, or ask a designated driver to get you back home.

Mothers Against Drunk Driving (MADD) began a campaign dubbed the Give the Gift of a Designated Driver, and it helps those who want to be a designated driver to let their friends and family have the option of getting a ride home after the festivities come to an end.

MADD reports that 32% of all deadly accidents in 2010 in Massachusetts involved a driver who was drunk at the time of the crash.  Of those fatal crashes in the Commonwealth last year, 108 people died because of drunk driving.

Please make plans today to get home safely after enjoying the game.

Storm Causes Widespread Spinouts, Disabled Cars

Yesterday’s and this morning’s snowstorm in Massachusetts has caused many spinouts and disabled vehicles on the Merrimack Valley's major highways like Interstates 495, 94, 93, Route 3 and others.

Luckily, very few of these incidents resulted in serious collisions.
The Andover State Police barracks have reported a dozen disabled vehicles and accidents since midnight, only one of which was caused by drunken driving and resulted in injuries.

The OUI accident occurred on Route 3 in Chelmsford about 1:30 am, involving a 39-year-old driver Alicia Otero who crashed her 2006 Hyundai Sonata into another vehicle. Otero was cited for driving under the influence of liquor and a marked lanes violation and was taken to Lowell General Hospital with minor injuries.
The other accidents were minor and no one was injured.

We urge all Merrimack Valley drivers to exercise extra caution while driving as the roads may still be covered in last night’s snow.

Massachusetts Auto Accident Victims - Do You Really Need an Attorney?

Insurance companies don’t want you to hire a lawyer for any injury claim you may have because they know that they’ll probably end up paying you more money. Don’t let an insurance adjustor or a lawyer who works for the insurance company force you to make a decision about a claim. If you feel like you need a lawyer to help you through this process, then it might be time to start researching your legal options.

The size of your potential case will determine if you should handle the case on your own or if you should retain an attorney. If the car accident you were in results in little or no damage to your car, requires medical treatment for a couple of months with minor injuries, and medical bills that are under a few thousand dollars, then you can typically settle your claim on your own without an attorney.

If the injuries are more severe and threaten to be permanent and the circumstances of the accident are significantly more complex, it may be beneficial to consult with an attorney about your potential claim.

Here are some unfortunate occurrences that could happen in the aftermath of a car accident:
  • The insurance company might be reluctant in investigating your injury claim and who was ultimately responsible in the crash
  • The person who was at fault for the accident may not report it to his or her insurance company
  • The person who was responsible may not even have coverage for the injuries you suffered in the accident. If that happens, you may have to file a claim through your policy. This is one of the reasons why underinsured motorist (UIM) coverage and uninsured motorist (UM) coverage are the most important coverages you can possibly have
  • If your car repairs cost more than what it’s actually worth, you may have to replace it
  • If you don’t own the car, either the bank or car dealership could repossess the title if your payments aren’t up to date
An experienced personal injury lawyer will understand the value of assorted injury claims and can then more effectively communicate and defend that value to insurance companies. Again, insurance companies will have attorneys who work for them and so should you.

If you want to know more about filing personal injury claims, order Massachusetts car accident attorney Thomas M. Kiley's free book "The 7 Mistakes That Can Wreck Your Massachusetts Accident Case" now! The PDF version of the Massachusetts Accidents Book is available right away. A hard copy of the book will be mailed to Massachusetts residents only.

Another Winter Storm Makes for Messy Commute

Massachusetts faces yet another slick storm today with snow, sleet, rain and whatever else Mother Nature decides to serve up.  The precipitation started earlier this morning as snow, giving way to a freezing rain and sleet mixture this afternoon in most areas. Rain is expected in the evening and overnight hours and as the colder temperatures kick in, officials have warned of icing on the roadways.

This morning’s commute was met with a number of accidents and cars spinning out due to the snowy conditions. The MBTA also announced that some of the commuter lines were facing delays as the falling flakes impacted the rush to get to work. Western Massachusetts had been warned of the potential for roofs to collapse due to the combination of fluctuating precipitation and temperatures hovering around 0 or below.

Try to take the extra time in getting home during tonight’s commute, for your safety and everyone else’s on the roadways.

The Big Dig: Facing the Aftermath of Wednesday's Storm in Lawrence

The Merrimack Valley is still digging out from under the snow that hit the region this past Wednesday, right along with many other Massachusetts communities. The City of Lawrence has had an especially tough time clearing streets and sidewalks, according to an article out today.

Lawrence received about 20 inches of snow and had 13 public works crews battling the intense storm, along with 63 private contractors.

Budget cuts rolled into the city over the past year as a sign of the troubling economic times, resulting in fewer public works employees.

Residents voiced frustrations that the snow-covered streets had been significantly narrowed by towering snowdrifts from the storm and created “impassable” roadways in general.  Vehicles were fishtailing and spinning out yesterday afternoon still on the snowy, slushy streets.

In response to the countless complaints that were phoned in following the storm, Mayor William Lantigua called on private plow drivers to submit applications to his office in order to work for the city.

Governor Patrick lifted the state of emergency yesterday that Massachusetts had been under since about 12:00pm on Wednesday. Thankfully, there were no major car accidents on the roadways during the storm and in the hours of plowing after the last flake fell.  Many Massachusetts residents decided to play it safe and stay at home on Wednesday, which clearly helped officials in the majority of the state to clear the roadways.

Fatal 93 Crash in Windham, NH Claims Life of Woburn Teen

Joseph Briere, 19, of Woburn succumbed to injuries last night that he suffered in a deadly rollover crash during yesterday’s evening rush hour on I-93 South in Windham, NH.

Briere was one of four passengers in an Isuzu Trooper that was going south on 93 around 5:00pm between Exits 3 and 4 when it went off of the highway, crashed into a guardrail, rolled over and came to a rest on the driver’s side in the middle lane of the highway. There were no other vehicles in the deadly crash.

The Trooper was being driven by Kyle Ahearn, 19, also of Woburn. Three passengers besides Briere were in the vehicle and were named as Woburn residents Shshank Samual, 20, Patrick Raistrick, 18, and Ethan Ahearn, 15.

Samual, Raistrick, and both Ahearns were taken to a local hospital for non-life-threatening injuries. Briere was transported via helicopter to a Boston area hospital and was pronounced dead later that evening.

The crash happened right at the start of rush hour, which resulted in traffic coming to a standstill for miles on 93. Due to reconstruction of the accident scene, the area surrounding the crash was shut down for about an hour while officials did their best to reroute traffic and get cars moving. The highway was completely reopened about 9:00pm.
